The ordering of products presented on the website www.plots–discount.com in the electronic catalog designed by NEL SOLUTIONS is subject to the buyer’s acceptance and constitutes unconditional acceptance of all the general terms and conditions of sale described below. These general terms and conditions of sale apply to the buyer upon acceptance of the order, materialized by their electronic signature through the “validation click”, as well as by the communication of their bank details ensuring payment. This electronic signature has the same legal value as a handwritten signature between the parties in accordance with the provisions of the Civil Code. This double action constitutes full acknowledgment and unconditional approval of the general terms and conditions of sale set out below.

 

Article 1: Acceptance of the general terms and conditions of sale

These general terms and conditions of sale govern the relationship between NEL SOLUTIONS, a simplified joint-stock company registered with the Paris Trade and Companies Register under number 991 303 801, with its registered office at 99 rue des résistants, 59280 Armentières, and customers wishing to place an order on the website www.plots–discount.com. Any order placed by a customer on the website www.plots–discount.com implies unconditional acceptance of these general terms and conditions of sale. In accordance with Article L 132-1 of the Consumer Code, NEL SOLUTIONS undertakes not to unilaterally modify the clauses of the general terms and conditions of sale after the customer has accepted the order. These conditions apply to sales made via any website published by NEL SOLUTIONS, including www.plots–discount.com, whether the products are delivered or collected in-store according to the option chosen by the customer. NEL SOLUTIONS reminds that specific conditions for certain products or services may supplement these general terms. These are specified when the item is presented.

 

Article 2: Products

Customers are informed on the website of the essential characteristics of the products, based on documentation and information provided by suppliers. NEL SOLUTIONS reminds customers to read the instructions or any other information attached to the product or indicated on the product or its packaging (precautions for use, conditions of use, user and safety instructions, etc.). It is imperative to comply with best practices and applicable standards and regulations regarding installation or use of certain products and, where necessary, to involve a qualified professional. The customer is also informed that some work may require prior administrative authorization and must consult the relevant municipal authorities. Photographs, videos, diagrams or drawings are provided for illustrative purposes only and are not contractually binding. NEL SOLUTIONS emphasizes that product and price offers are valid for the duration of their publication online, unless otherwise stated. The absence of an “Add to cart” button means the product is not available for online sale. Adding a product to the cart does not constitute order validation, as availability may change before confirmation.

The customer acknowledges having been fully informed of this possibility by NEL SOLUTIONS. In-store pickup is only available in certain stores and for selected products, subject to availability confirmation.

 

Article 3: Order

3.1 Account management and creation

The customer certifies that they are of legal age and capable of entering into a contract, and are not under guardianship or trusteeship. The customer places their order according to the procedures in force on www.plots–discount.com and confirms the detailed summary. The customer must provide accurate information necessary for identification: name, delivery and billing address, email, and phone numbers.

For delivered orders, additional details must be provided such as access codes and contact availability for delivery appointments. For in-store pickup: mobile number (SMS/MMS), landline, and email.

To place an order, the customer must create an account either before or during the process by clicking “Create an account”. Mandatory information must be accurate. In case of error, NEL SOLUTIONS cannot be held responsible for delivery issues. The customer may update their information at any time and access invoices in “MY ACCOUNT”.

 

3.2 Order placement and validation procedure

Information recorded on the website constitutes proof of transactions between NEL SOLUTIONS and its customers. Placing an order implies payment. Products are offered subject to stock availability. Orders can be placed online.

The customer selects products and quantities, adds them to the cart or selects in-store pickup. A cart cannot mix delivery and pickup. The customer may modify the cart at any time, choose a delivery method, identify themselves, confirm addresses, and finalize the order by clicking “ORDER”. A summary is displayed including total price and delivery costs. Payment details are entered on the final screen. Shipment or pickup is subject to payment confirmation. A confirmation email is sent.

NEL SOLUTIONS will inform customers of stock shortages. It reserves the right to cancel orders in case of non-compliance or incorrect information. It may also refuse large quantity orders. It is not liable for force majeure events affecting order processing.

 

3.3 Excess order

If the customer orders too many goods, they may return the excess within 90 days, provided the items are in perfect condition (clean and new).

The customer bears return shipping costs and a €14.90 handling fee, deducted from the refund. Refunds are issued via the original payment method.

 

Article 4: Delivery and in-store pickup

4.1 Determination of delivery costs

Shipping costs are indicated in the cart and include handling and delivery fees. Handling is a fixed fee covering preparation, packaging, and insurance.

Delivery fees apply unless otherwise stated (e.g., “Free delivery”). Fees are based on total order weight for mainland France and Monaco, with specific rates for Europe. Corsica may have special conditions.

The customer is informed before shipment and may cancel the order. Fixed delivery fees may apply for certain products. All costs are shown in the order summary and invoice.

The customer acknowledges full awareness of these costs.

 

4.2 Delivery terms

Force majeure events (weather, strikes, etc.) may delay delivery. A new date will be agreed upon. The customer must provide accurate access details for delivery.

Delivery is made to the address provided. Packages are delivered to mailbox, curbside, or building entrance (no upstairs delivery). Appointments are scheduled with the customer, who must be present.

Large deliveries require specific access conditions for trucks. The customer must ensure accessibility. If access is impossible due to incorrect information, delivery may be canceled and refunded minus shipping costs.

Failure to receive delivery results in loss of shipping fees and deduction of return costs. A new delivery requires new payment.

Orders may be split without extra cost. Separate addresses require separate orders.

If the customer is absent, a new appointment is arranged and additional fees may apply.

Perishable goods and delivery fees remain payable in case of cancellation. Other products are refunded within 14 days.

 

4.3 Inspection and verification

The customer must check goods before signing delivery documents. Any issue must be noted and signed. Damaged goods should be refused.

Claims must be confirmed within 14 working days. The seller will refund or replace non-compliant products.

Returns must be complete and in original condition. Return costs are reimbursed in such cases.

 

4.4 In-store pickup

With the “DRIVE” option, the customer must collect products within:

Stores are open 5 days a week (except holidays). Deadlines may be extended if closed.

Orders not collected may be canceled. Pickup must be done in one visit. No refund after one month.

 

Article 5: Withdrawal, exchange, and refund

5.1 Principle

The customer has 14 days to withdraw without justification, except for personalized or perishable goods.

The period starts the day after receipt. If it ends on a non-working day, it is extended.

 

5.2 Exercise of the right of withdrawal

The customer must notify NEL SOLUTIONS before the deadline via clear declaration (email or registered letter). A confirmation will be sent. Simply returning the product is not sufficient.

 

5.3 Return conditions

The customer is responsible for depreciation caused by improper handling. Items must be returned complete, unused, and in original packaging.

Returns must be made within 14 days after withdrawal. Costs are borne by the customer.

 

5.4 Refund

Full refund (including delivery) within 14 days for withdrawals within the legal period. After that, only product price is refunded.

Refund may be delayed until goods are received. It is made using the original payment method.

 

Article 6: Price

Product prices exclude delivery costs. Total price (including VAT) is shown at checkout.

Any advance payment is considered a deposit. Typographical errors may lead to order cancellation.

 

Article 7: Payment

Payment is due in full on the day of order via card, PayPal, or bank transfer. Orders are confirmed after payment authorization.

 

Article 8: Disputes – Applicable law

These terms are governed by French law. Only French courts have jurisdiction.

In the event that no agreement can be reached, the customer may either:

• Prior to any legal action before the competent court, refer free of charge to the local conciliator (Conciliateur de la République) of their place of residence for goods delivered in France and overseas territories in order to seek an amicable resolution of the dispute;

• Submit a free claim to the consumer mediator whose contact details are as follows: MEDICYS, www.medicys.fr, 75 Boulevard de Clichy 75009 PARIS.

Disputes between NEL SOLUTIONS and professionals fall under the exclusive jurisdiction of the Commercial Court of Paris, unless mandatory jurisdiction rules apply by virtue of a legislative or regulatory provision.

Article 9 - Retention of title and transfer of risks

The products delivered remain the property of NEL SOLUTIONS until full and effective payment of the price by the customer, i.e. actual receipt of payment.

The customer shall bear all risks of loss or damage to the products: either from the moment the customer or a third party designated by them takes physical possession of the goods, or from the handover of the goods to the carrier when the customer has entrusted delivery to a carrier other than the one proposed by NEL SOLUTIONS.

Article 10: Legal warranties

The Products sold on the website www.plots-discount.com comply with the regulations in force in France and have performance compatible with non-professional use. The Products supplied by the Seller benefit automatically and without additional payment, independently of the right of withdrawal, in accordance with legal provisions:

• From the legal guarantee of conformity, for apparently defective, damaged or non-compliant Products;

• From the legal guarantee against hidden defects arising from material, design or manufacturing faults affecting the Products delivered and making them unfit for use;

Under the conditions and according to the terms set out below and defined in the appendix to these General Terms and Conditions of Sale (Guarantee of Conformity / Hidden Defects Guarantee).

To assert their rights, the Customer must inform the Seller of the non-conformity or hidden defects within the above-mentioned time limits and return the defective Products in the condition in which they were received with all components (accessories, packaging, instructions, etc.).

In accordance with applicable regulations, the Seller will refund, replace or repair Products or parts under warranty deemed non-compliant or defective.

Refunds for Products deemed non-compliant or defective will be made as soon as possible following the Seller’s identification of the defect.

The refund will be made by crediting the Customer’s bank account or by bank cheque sent to the Customer.

The Seller shall not be held liable in the event of misuse, professional use, negligence or lack of maintenance by the Customer, nor in the event of normal wear and tear, accident or force majeure.

The Seller’s warranty is, in any case, limited to the replacement or refund of non-compliant or defective Products.

NEL SOLUTIONS advisors are in constant contact with the customer services of the distributed brands and with manufacturer-approved repairers. NEL SOLUTIONS does not hold spare parts. For any technical issue or request for information, contact our customer service via the contact form, which will provide you with the details of the manufacturer-approved repairer. In the event of returning an item under warranty, it must be returned in its original packaging, with all accessories, instructions and documentation, and the return authorization email from NEL SOLUTIONS customer service. Any incomplete return or return with damaged packaging will be refused and sent back to the customer at their expense.

Article 11: Legal information

Contractual information is presented in French. Non-emancipated minors do not have the legal capacity to contract and therefore cannot place orders on our website.

All elements of this Site (texts, photographs, illustrations, trademarks, logos, icons, etc.) are the exclusive property of NEL SOLUTIONS. These elements are protected by French law and international texts relating to copyright and trademarks. The online publication of this Site does not grant any license to use its elements, such use being subject to the prior written consent of the owner.

The customer’s email address enables NEL SOLUTIONS to confirm orders, send invoices, and confirm responses provided by customer service.

The customer’s banking details are encrypted via SSL and are inaccessible to third parties.

These data may be transmitted to partners responsible for processing, managing, and executing orders.

The processing of information complies with legal data protection requirements, and the system ensures optimal protection.

The Customer has the right to access, modify, rectify, oppose, transfer and limit processing of their data in accordance with regulations. The Customer may also modify their data directly on the website.
